1. GENERAL
1.1. These are the terms and conditions of sale of Latitude 56 Degrees Limited (trading as LAT56), whose registered office is at Suite 314, 4th Floor, Central Chambers, 93 Hope St, Glasgow, G2 6LD, Scotland. Registered in Scotland with Company Number SC329614 and VAT Number 946792862 ('we' or 'us'). Our agent in the USA is Tartan Commerce LLC, which is located in California. These terms apply to the purchase of LAT56 products made using the US.lat56.com website. We recommend that you read this document carefully before placing your order. We reserve the right to make changes to these Sale Terms at any time. You will be subject to the Sale Terms in force at the time you place your order with us.

2. YOUR ORDER
2.1. Every order that you place on this website will be subject to acceptance in accordance with these Terms and Conditions.

2.2 The final details of your order will be set out during the checkout phase of your order. Checkout and payment for your order is managed by Amazon Payments and is subject to Amazon.com practices and Amazon.com Conditions of use and the Amazon Payments User Agreement. We reserve the right to cancel any order and/or refuse access to the website. It is your responsibility to inform us immediately if there are any errors in your order.

3. PRODUCT GUARANTEE
3.1. LAT56 offers a limited lifetime guarantee against possible defects in materials and craftsmanship of all products. We also cover third-party airline damage. The guarantee starts from the date the product was purchased. In the event of a defect arising during the guarantee period, please contact LAT56 by email at US.CustomerService@lat56.com.

3.2. LAT56 products are warranted to be free of any defects in materials and workmanship for the life of the product. As part of this guarantee we also cover third-party airline damage. You will need to provide proof of the airline travel during which the damage took place and seek acknowledgement from the airline that they are at fault.

3.3. LAT56 will, at our sole option, either repair or replace defective LAT56 products free of charge. Replacement and repairs are handled promptly.

3.4. This limited lifetime guarantee does not cover any damage caused by misuse or neglect, accidents, abrasion, exposure to extreme temperatures, solvents, acids, water, normal wear and tear, cosmetic damage or third-party abuse excluding airline damage.

3.5. This guarantee does not cover the cost of returning the product to our nominated repairs location.

4. PRICE
4.1. The price that you pay for the product will be the price that is displayed on the website during checkout. This detail will include product prices, local relevant sales tax and delivery.

4.2. Any discounts we offer are time-limited and are dependent on product availability. Accordingly, the price of such products may change from time to time.

4.3. We will endeavor to ensure that all prices on our website are accurate. However, pricing errors may occur. If an error is found in the price of the product you have ordered, we will contact you as soon as possible. If a product's correct price is lower than the price stated on our website, we will charge the lower amount to your debit or credit card and send the product to you. If a product's correct price is higher than our stated price, then we will give you the option of either continuing with your purchase at the correct price or canceling the order affected by the error. We will deem the order cancelled if we do not receive a response from you within 24 hours of our first attempt to contact you. In such a case, if applicable, we will refund the total amount we deducted from your debit or credit card.

5. DELIVERY
5.1. All products are fulfilled and delivered by the Fulfillment by Amazon service. This means that you will take advantage of Amazon’s best practices for shipment of products to you. Details can by found by viewing Shipping & Delivery on Amazon.com.

5.2 All delivery issues are handled directly by Amazon but should you need assistance, please contact us at us.customerservice@lat56.com.

6. RISK AND TITLE
6.1. Ownership of the Goods and the risk of damage to the Goods will pass to you upon delivery.

7. RETURNS
7.1. If you are not completely satisfied with any product you buy from www.lat56.com, you can return it within 30 days of receipt for a full refund (not including shipping costs).

7.3. For your own protection, we recommend that you use a trackable shipping method to return your product to us. You are responsible for the cost of returning products, unless we delivered the items to you in error or they are faulty.

7.4 You will be issued a refund upon our receipt of your return.

8. LIMITATION OF LIABILITY
8.1. To the extent permitted by applicable law, in no event will we be liable for any damages arising from or relating to any product purchased from LAT56 or the use of or inability to use any such product including, but not limited to any loss of use, lost profits, loss or damage to goodwill or business nor for any consequential, indirect or incidental damages.

8.2. To the extent permitted by applicable law, our aggregate liability (whether in contract, tort or otherwise) for any loss or damage shall, in any event, be limited to a sum equal to the amount paid for the product in question.

9. GOVERNING LAW
9.1. These terms are governed by the laws of Scotland and the Scottish courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.

9.2. No waiver by us of any breach of these terms by you, is considered as a waiver of any subsequent breach of the same or any other provision.

10. AMENDMENTS
10.1. We reserve the right to make changes to these terms at any time. You will be subject to the terms in force at the time you place your order with us.
